Here's a Lessig friendly piece on Eldred vs. Ashcroft in
Businessweek, of all things, as well as a note saying Berman and Coble (sponsors of the Media Cartel Vigilante
bill) are
surprised there's opposition. Perhaps the start of this New Yorker piece sums it up best -- public-interest unfriendly legislation happens because the public generally shows
no interest. Pre-Internet, it would be hard to organize folks interested in protecting the Internet, and tracking hostile legislation.
